**TERMS OF SERVICE AGREEMENT**
**Ultimate Community Health & Fitness**
Please read these Terms of Service (“Agreement”) carefully before using the facilities, services, or programs offered by Ultimate Community Health & Fitness. By accessing or using our gym, you agree to be bound by the terms outlined below.
**1. Acceptance of Terms** By signing this Agreement or using the facilities, you acknowledge that you have read, understood, and agree to comply with these Terms of Service.
**2. Eligibility (Age Requirement) ** You must be at least eighteen (18) years of age to use the facilities independently. Individuals under eighteen (18) years of age may only use the facilities with the signed consent of a parent or legal guardian, who agrees to these Terms on their behalf.
**3. Membership and Access** Access to Ultimate Community Health & Fitness may require an active membership, pass, or prior authorization. Memberships are non-transferable and may not be shared unless explicitly permitted.
Members are responsible for all individuals they allow or assist in gaining access to the facility using their membership, access credentials, key fob, access card, mobile access, or any other means of entry.
If an individual who is not an authorized member gains access to or uses the facility under a member’s access credentials, the member may be held responsible for the unauthorized access and may be charged the applicable unauthorized visitor or guest fee, as determined by UCHF.
Members may also be responsible for any membership fees, access fees, damages, costs, or other charges resulting from unauthorized use of their membership or access credentials.
Allowing another person to use a member’s membership or access credentials does not create membership rights for that individual. UCHF reserves the right to deny access to unauthorized individuals and to take appropriate action regarding the member’s account.
**4. Code of Conduct** All members and guests are expected to behave respectfully and responsibly. The following actions are prohibited:
* Harassment, intimidation, or inappropriate behavior toward staff or other members
* Misuse or damage of equipment or facilities
* Use of the facility while under the influence of drugs or alcohol
* Failure to follow posted rules or staff instructions Ultimate Community Health & Fitness reserves the right to suspend or terminate access for violations of this code.
**5. Health and Safety** You agree to use equipment and participate in activities safely and responsibly. You are responsible for understanding your own physical limits and for consulting a healthcare provider if needed before engaging in exercise programs.
**6. Personal Property** Ultimate Community Health & Fitness is not responsible for lost, stolen, or damaged personal belongings. Members are encouraged to secure their items appropriately.
**7. Scheduling and Classes** Classes, programs, and services may require advance booking and are subject to availability. Ultimate Community Health & Fitness reserves the right to modify or cancel schedules, classes, or services at any time.
**8. Payments and Fees** All membership fees, class fees, and other charges must be paid as agreed. Late payments may result in suspension or termination of access. Fees are non-refundable unless otherwise stated in writing.
The member acknowledges and agrees that UCHF may charge any additional credit card or other payment method that the member has provided or authorized on their account when necessary to cover recurring membership costs, unpaid balances, approved fees, or other charges owed under the membership agreement.
Providing multiple payment methods does not cancel, replace, or modify the member’s financial responsibility for amounts due. Members are responsible for maintaining valid
payment information on their account and ensuring that sufficient funds or available credit are available when charges are processed.
If a primary payment method is declined, expired, or otherwise unavailable, UCHF may attempt to process the amount due to using another authorized payment method on the member’s account.
**9. Cancellations, Termination and Freeze** Members may cancel their membership according to the terms of their membership agreement. Ultimate Community Health & Fitness reserves the right to terminate or suspend membership at its discretion for violations of these Terms.
Please be advised that cancellation of your membership does not result in an immediate termination of billing obligations. The member will continue to be charged for the remainder of the current billing cycle. Access to services will remain active until the end of this billing period.
All cancellation and freeze requests must be submitted **in writing** within fifteen (15) days of the start of the billing cycle. Requests made within this timeframe will be processed accordingly; however, charges for the current billing cycle will still apply and will not be prorated or refunded.
Cancellation requests will **not be processed** and considered officially received until all required documentation has been fully completed and received by both parties. It is the member’s responsibility to ensure that all necessary forms are accurately filled out and properly submitted. Membership changes, freezes, cancellations, or other requests do not eliminate charges that were properly incurred before the effective date of the approved change. Members remain responsible for all outstanding balances, fees, and charges associated with their account.
Members may request to temporarily freeze or place their membership on hold. All freeze requests must be submitted in writing and are not considered effective until the required documentation has been properly completed and received by UCHF.
A membership freeze may be placed on hold for a maximum period of six (6) months. The specific start and end dates of the freeze must be documented and approved by UCHF.
Unless otherwise stated in a written agreement, membership freezes do not automatically extend beyond the approved six-month period. Once the approved freeze period expires, the membership will automatically resume, and regular membership charges will begin or continue according to the member’s membership agreement.
Members are responsible for submitting any required documentation before the requested freezing date. Verbal requests, phone calls, text messages, or informal requests may not be accepted as official notice unless specifically approved by UCHF.
**10. Facility Hours and Changes** Operating hours may vary and are subject to change without notice due to holidays, maintenance, or other circumstances.
**11. Intellectual Property** Any materials, branding, or content provided by Ultimate Community Health & Fitness are the property of the business and may not be used or reproduced without permission.
**12. Limitation of Liability** To the fullest extent permitted by law, Ultimate Community Health & Fitness shall not be liable for any indirect, incidental, or consequential damages arising from your use of the facilities or services.
**13. Governing Law** This Agreement shall be governed by and interpreted in accordance with the laws of the state in which Ultimate Community Health & Fitness operates.
**14. Changes to Terms** Ultimate Community Health & Fitness reserves the right to update or modify these Terms of Service at any time. Continued use of the facilities constitutes acceptance of any revised terms.
**15. Entire Agreement** This Agreement constitutes the entire understanding between you and Ultimate Community Health & Fitness regarding use of the facilities and services.
